Acceptable Use Policy
1. General Standards
All users must:
- Use the Platform in good faith and in compliance with all applicable local, state, national, and international laws and regulations;
- Treat all other users — including Business Owners and Clients — with respect, dignity, and professionalism;
- Provide accurate and non-misleading information in all Platform interactions;
- Maintain the confidentiality of account credentials and promptly notify flyk of any unauthorized access.
2. Business Owner Conduct Standards
2.1 Service Representation
- Business Owners must accurately represent their qualifications, credentials, certifications, experience, and services;
- Business Owners may not list services they are not legally authorized to offer (e.g., providing licensed professional advice without the required license);
- Business Owners must honor confirmed Bookings or provide advance notice and appropriate refunds consistent with their stated cancellation policy;
- Profile information, including AI-generated content from the onboarding pipeline, must be reviewed by the Business Owner and must not contain false or misleading claims before activation.
2.2 Reputation Integrity
- Business Owners must not solicit, incentivize, or manufacture false reviews, fake completed sessions, or artificial attestations;
- Business Owners must not attempt to manipulate the trust score or reputation system through coordinated inauthentic behavior;
- Business Owners must not import reputation signals from sources they do not own or have not authorized;
- Business Owners must not use the portable reputation export to misrepresent their standing on other platforms or in other contexts.
2.3 Client Relationships
- Business Owners must treat Clients professionally and without discrimination on the basis of race, color, religion, sex, national origin, age, disability, sexual orientation, or any other characteristic protected by applicable law;
- Business Owners must not use Platform communications to harass, threaten, or intimidate Clients;
3. Client Conduct Standards
- Clients must not make Bookings with no genuine intent to attend, or systematically exploit cancellation policies;
- Clients must not submit false, defamatory, or misleading reviews or attestations about Business Owners;
- Clients must not attempt to identify or contact Business Owners using information obtained outside official Platform channels;
- Clients must not harass, threaten, or engage in abusive behavior toward Business Owners before, during, or after a Session;
- Clients must not record Sessions — by any means, including screen recording or audio capture — without the explicit prior consent of the Business Owner and in compliance with all applicable wiretapping, recording, and privacy laws.
4. API and Consumer Agent Operator Standards
4.1 Authorized Use
Access to the flyk Discovery API and AFODP-compliant endpoints is permitted for:
- Operating a Consumer Agent that presents flyk Business Owner discovery results to end users in a non-deceptive manner;
- Building tools that help Business Owners manage their flyk presence, availability, or profile;
- Research and development consistent with the stated purposes of the Platform;
- Testing and validating AFODP-compliant implementations.
4.2 Prohibited API Use
The following API uses are prohibited:
- Systematic scraping or harvesting of Business Owner data for use outside the Platform without a separate data licensing agreement with flyk;
- Using API access to train competing AI models, recommendation systems, or discovery platforms on Business Owner data;
- Attempting to circumvent API rate limits, authentication requirements, or access controls;
- Presenting flyk Business Owner data in a manner that is misleading, defamatory, or that attributes false characteristics to Business Owners;
- Using API access for purposes that violate any Business Owner’s reasonable expectations of privacy or data use;
- Operating automated systems that create, modify, or delete Platform accounts or data without explicit user consent;
- Reselling or redistributing raw Business Owner data obtained via the API without a separate commercial agreement.
4.3 Consumer Agent Disclosure Requirements
Consumer Agent operators accessing the Platform on behalf of end users must:
- Ensure their end users are aware they are interacting with an AI agent in any Platform-mediated conversation;
- Comply with all applicable AI transparency, disclosure, and consumer protection laws and regulations in their operating jurisdiction;
- Not use flyk data to make automated decisions that have legal or similarly significant effects on individuals without appropriate human oversight;
- Not misrepresent the source, recency, or accuracy of Business Owner data obtained via AFODP to end users.
5. Prohibited Content
The following content is prohibited on the Platform in all contexts — profile data, messages, reviews, AI agent outputs, and API payloads:
- Content that is illegal, fraudulent, or facilitates illegal activity;
- Content that infringes intellectual property, trademark, copyright, or trade secret rights;
- Hate speech, harassment, threats, or content that demeans or discriminates against individuals or groups based on protected characteristics;
- False or misleading professional credentials, licenses, certifications, or affiliations;
- Spam, unsolicited commercial communications, or phishing attempts;
- Malware, viruses, exploits, or other harmful code submitted via any channel (API, profile, messaging, agent conversation);
- Content that violates any individual’s privacy rights, including unauthorized disclosure of personal information;
- Sexually explicit content in any Business Owner profile, messaging, or AI agent output.
6. Platform Integrity
The following actions threaten Platform integrity and are strictly prohibited:
- Attempting to access accounts, data, or systems you are not authorized to access;
- Reverse engineering, decompiling, or disassembling Platform software, AI models, ranking algorithms, or trust score computation systems;
- Probing, scanning, or testing the vulnerability of Platform systems without explicit written authorization from flyk’s security team;
- Interfering with the availability or performance of the Platform through denial-of-service attacks, resource exhaustion, or similar methods;
- Attempting to corrupt, alter, or destroy Platform data, including the append-only reputation attestation ledger;
- Creating multiple accounts to circumvent account bans, rate limits, or feature restrictions;
- Injecting false data into the reputation attestation pipeline or the trust score computation system.
7. AI Agent and Automation Standards
Given flyk’s AI-native architecture, specific standards apply to all automated and AI-driven interactions:
- Accurate representation: AI agents operating on behalf of Business Owners must accurately represent Business Owner information and must not make false claims about Business Owner capabilities, qualifications, availability, or pricing;
- Authorization: automated scheduling, booking, or cancellation actions must be genuinely authorized by the Business Owner or Client on whose behalf they are taken. Unauthorized automated actions on behalf of other users are prohibited;
- Prompt injection defense: attempts to manipulate flyk’s AI systems through malicious inputs — including prompt injection attacks, adversarial payloads in API requests, or instruction injection in profile data — are prohibited and may be reported to law enforcement;
- No AI impersonation of humans: AI agents operating on the Platform must not represent themselves as human to Clients who genuinely and sincerely ask whether they are speaking with a human or an AI;
- No unauthorized data exfiltration: AI agents operating on the Platform must not attempt to extract, transmit, or cache Business Owner or Client data beyond what is necessary for the immediate task authorized by the user.
8. Reporting Violations
If you believe another user, API operator, or third party has violated this AUP, please report it to legal@flyk.app with:
- A description of the conduct;
- The Platform user, URL, or API key involved (if known);
- Any supporting evidence (screenshots, request logs, etc.).
We investigate all good-faith reports promptly and take appropriate action. Reports made in bad faith to harm competitors or other users are themselves a violation of this AUP.
9. Consequences of Violations
Violations of this AUP may result in:
- Written warning and required corrective action within a specified timeframe;
- Temporary suspension of specific account features or API access;
- Permanent termination of account and API access without refund of prepaid subscription fees;
- Removal from the AFODP registry and all Consumer Agent discovery channels;
- Legal action where violations cause material harm to flyk, other users, or third parties.
flyk reserves the right to determine, in its sole and reasonable discretion, whether conduct violates this AUP. We apply these standards consistently and without discrimination. We will make reasonable efforts to notify users before taking action except where the violation requires immediate action to protect Platform integrity or user safety.
10. Updates to This Policy
We may update this AUP as the Platform evolves, new capabilities are added, or legal requirements change. Material changes will be communicated via the same channels described in the Terms and Conditions — email or prominent Platform notification — at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated AUP.
